MAGISTRATES COURT of TASMANIA

CORONIAL DIVISION Record of Investigation into Death (Without Inquest) Coroners Act 1995 Coroners Rules 2006 Rule 11 I, Simon Cooper, Coroner, having investigated the death of Steven George Streets Find, pursuant to Section 28(1) of the Coroners Act 1995, that a) The identity of the deceased is Steven George Streets.

b) Mr Streets died as a result of injuries sustained when, as the rider of a motorcycle on a public street in Devonport, he was struck by a motor vehicle driven by Tony Leigh Burgess. The accident was caused by the inattention of Mr Burgess. I am satisfied that Mr Streets had traces of THC (the active constituent of cannabis) in his body at the time of the crash. I am also satisfied that Mr Burgess had alcohol in his body at the time of the crash. The evidence satisfies me that neither road conditions and nor weather caused or contributed to the happening of the crash. I am also satisfied on the evidence that the vehicle driven by Mr Burgess and the motorcycle driven by Mr Streets were both mechanically sound. Therefore, mechanical deficiency neither caused nor contributed to the happening of the crash. Likewise, speed on the part of Mr Streets and Mr Burgess did not cause or contribute to the happening of the crash.

c) The cause of Mr Streets’ death was lower limb and chest injuries. Those injuries included multiple compound fractures of the right leg bones, a left pneumothorax, and bilateral anterior upper rib fractures. Contributing factors included cardiomegaly and critical narrowing of the left anterior descending and right coronary arteries.

d) Mr Streets died on 27 October 2019, at North West Regional Hospital, Burnie in Tasmania.

I note that Mr Burgess was charged with various offences arising out of the accident that claimed Mr Streets’ life.

This finding necessarily had to await the outcome of those proceedings before it could be completed. Those proceedings were finalised in May 2021. The delay of several months that followed the completion of those proceedings and the submission of the investigation file to my office is inexcusable.

Comments and Recommendations The circumstances of Mr Streets’ death are not such as to require me to make any comments or recommendations pursuant to section 28 of the Coroners Act 1995.

I convey my sincere condolences to the family and loved ones of Mr Streets.
