in the following circumstances:

  1. Taner Kirim was aged 17 years at the time of his death. He lived at Bayview House, a residential care unit situated at 28 Bayview Road, Frankston South.

  1. Taner had been in the care of the Department of Human Services (DES) Child Protection

Unit since December, 2008. At the time of his death, he was on an Interim Accommodation Order for "Out of Honie Services".

  1. Mr Dube, careworker employed by Statewide Autistic Services worked the sleepover shift at Bayview House.

4, Mr Dube explained that Taner was fed though his PEG feed and nappy’s changed: "The last time I saw Taner alive was at 9.45pm.

The next morning I got up and opened the door for my then co-worker Darya, I got Taner’s feeds ready and was the Ist to go to check him. When I walked into his room, I saw that he had a pale look on his face and I immediately knew something was wrong. T called out to Darya to come quick and we checked fora pulse and called for Megan the manager, and the ambulance. The ambulance arrived within 5 minutes, followed by the

police."

  1. On the 21st January, 2009, Dr Shelley Robertson, Forensic Pathologist at the Victorian Institute of Forensic Medicine, performed an autopsy on the body of Taner Kirim.

  2. She found the cause of death to be epilepsy with contributing factors of cerebral palsy and intellectual disability.

8. Dr Robertson commented as follows:

“This 17 year old male, Taner Kirim, died from natural causes with the most likely cause of death being related to his clinical history of epilepsy. He had evidence of macroscopic brain abnormality. Toxicological analysis was negative for ethanol and showed levels of valproic acid and lamotrigine which are consistent with therapeutic usage."

  1. Taner’s death is particularly tragic for his mother Husnuye Acikyurt. Ms. Acikyurt had

cared for Taner throughout his life. His declining health and associated weight loss lead to his out of home placement in December 2008.
