FORM 37 Rule 60(1)

FINDING INTO DEATH WITH INQUEST Section 67 of the Coroners Act 2008

Court reference: 1772/11 In the Coroners Court of Victoria at Melbourne I, KIM PARKINSON, Coroner having investigated the death of: Details of deceased:

Unidentified Human UNKNOWN REMAINS LOCATED IN PORT PHILLIP

Remains: BAY IN 1968 AND having held an inquest in relation to this death on 28 July 2011 at Melbourne

Find: that the idenity of the deceased was unknown and that the reamains are human and comprise in Case Number 1255 of 1968, bones of a left foot and in Case Number 2791 of 1968, a partial pelvic bone.

That: the death occurred at an unknown date At: an unknown location From: an unknown cause

In the following circumstances:

  1. This matter was listed for inquest this day in circumstances where the remains had been identified by members of Victoria Police Belier Task Force as not ever having been the subject of.

an inquest or finding.

  1. The bones in Case number 1255 of 1968 were located by a fisherman whilst dredging three miles off Point Cook on 26 April 1968.

3, The bones in Case number 2791 of 1968 were located by a fisherman whilst dredging five miles south of Altona on 12 August 1968.

2 of 3

  1. The bones which were conveyed to the Coroner at that time, 1968, have subsequently been misplaced or disposed of in a manner unknown.

  2. No inquest or coronial finding was made in relation to the remains. In those circumstances I am asked to find that the person or persons is deceased and that the circumstances of death together with location and date of death are unknown.

  3. Whilst police have raised the possibility that the remains relate to the death of Mr Robert Wisbey, a fisherman who disappeared in Port Phillip Bay in 1968, there is insufficient evidence to support this theory. The death of Mr Wisbey was the subject of coronial inquest in Case number 3955 of 2003.

  4. I am satisfied that no further investigation is required. I find that the bones are human. On the available evidence it is not possible to make findings as to identity, where, when or in what circumstances the person or persons died or as to the age of the remains.

  5. I direct that Case files 1255 of 1968 , 2791 of 1968 and 3955 of 2003 be returned to

archives.
